PRIVACY POLICY


OUR COMMITMENT

At Helpful Comments we recognise that your privacy is very important to you; it is to Helpful Comments as well. We handle personal information provided by and about people every day. By personal information we mean information or an opinion about a person whose identity is apparent or can reasonably be ascertained.
We are a privacy compliant organisation, and committed to supporting, the National Privacy Principles (NPPs) set out in the Privacy Act 1988 (Cth). Our aim is to both support, and ensure that we comply with, the NPPs that form the basis of laws introduced to strengthen privacy protection for the general public. The information set out below is largely a summary of our obligations under the NPPs.
We believe that this Statement will address any potential concerns you may have about how personal information you provide Helpful Comments is collected, held, used, corrected, disclosed and transferred. COLLECTION

In the course of our activities you may disclose to us and we may collect and hold personal information, such as your personal details (including your name, age and address), the name of the businesses you have commented on and the comments you make about a business. Our main purpose in collecting that personal information is to provide this feedback to our corporate clients to enable them to assess the way in which they provide services to you and their other customers.
We will only collect personal information from you that you choose to disclose to us and that is necessary for our functions and activities. We will only collect personal information from you by lawful and fair means, without being unreasonably intrusive, such as when you log into our website to provide your feedback, when you call us to ask questions or provide further feedback and when we send you an email to which you reply.
At or before the time we collect personal information from you we will take reasonable steps to inform you why we are collecting that personal information, who else we might disclose that personal information to, and what will happen if you do not provide personal information to us.
Where reasonable and practicable, we will only collect personal information about you from you, other than when we obtain information about you from the business which has referred you to us.
As a default, you are not required to identify yourself or provide personal information. However, for us to provide gift vouchers, we will require you to nominate the name and address details of the person you wish to receive a gift voucher, for mailing purposes. This need not be you.
We will only collect sensitive information if you volunteer it. Sensitive information is a type of personal information and includes information regarding racial or ethnic origin, religious beliefs or affiliations and membership of professional or trade associations.
Once we hold personal information we will take reasonable steps to keep it accurate, complete and up-to-date. However, you are responsible for entering accurate information initially and you can also change your personal information at any time by logging in to your account on HelpfulComments.com.

USE AND DISCLOSURE

We will only use your personal information (including sensitive information) for the purpose of providing feedback to the businesses you choose to comment on, except where you consent to us using that information for another purpose or where it is permitted or required by law, or we reasonably believe it is necessary on health or public safety grounds to use or disclose the information for another purpose.
Sometimes our clients may approach us for statistical information about our users, such as their age and shopping preferences. We will not disclose this information to these clients, but may use this information internally to assist that client in developing marketing strategies.

ACCESS AND CORRECTION

If you ask, we will tell you what personal information we hold about you, and what we do with it. We will facilitate access to you by allowing an inspection of your personal information in person, or by providing copies or a summary of relevant documents, depending on what is most appropriate in the circumstances, following receipt of your request. Any charge we make for providing access will be reasonable. Please note that no charge applies for lodging an access request.
If you can show us that the personal information is inaccurate, we will take reasonable steps to correct it. If we disagree that the information is inaccurate, you may request that we associate with the information a statement claming that the information is not accurate, complete or up-to-date, and we will take reasonable steps to do so. Note that we need not provide access to personal information in several types of situation, for example where a request is frivolous, or where to provide access would pose a threat to health or public safety, unreasonably interfere with another person’s privacy, or be a breach of the law. If we refuse access we will advise you of our reasons for doing so.
Where we are not required to provide you with access because of one of the prescribed reasons, then we will consider whether a mutually agreed intermediary would allow sufficient access to meet our needs and yours.
However, you are responsible for entering accurate information initially and you can also change your personal information at any time by logging in to your account on HelpfulComments.com.

SECURITY

We will take reasonable steps to protect personal information from misuse and loss, and destroy or permanently de-identify personal information we no longer need.

IDENTIFIERS

We will not adopt as our own any identifiers that you may provide to us such as TENs, Medicare numbers etc.

SENDING DATA OVERSEAS AND THIRD PARTY WEBSITES

We will not send any personal information about you overseas unless you consent to this, or we reasonably believe that the other country has privacy laws substantially similar to our own.
Our website contains a number of links to other websites. We are not responsible for the privacy practices of these other organisations, and a link to another website on our website does not constitute any endorsement of that other website or that organisation.

COMPLAINTS RESOLUTION

We are committed to providing to customers, and to other parties whose personal information we hold, a fair and responsible system for the handling of their complaints.
If at any time you have any complaints in relation to privacy, please contact our Privacy Officer at one of the points referred to below. We will seek to address any concerns that you have through our complaints handling processes, but if you wish to take matters further you may refer your concerns to the Office of the Federal Privacy Commissioner.
